Use of Electronic Evidence on Rise
Today’s TMJ4, February 7, 2008
Troubled couples beware! According to a survey conducted by the American Academy of Matrimonial Lawyers, electronic records are becoming a very popular form of evidence in divorce cases. The majority of the nation’s top divorce attorneys, 82 percent to be exact, say that emails are the most popular form of electronic data used against spouses.
We find this interesting because electronic evidence is not only valuable in a corporate setting, but it proves useful in personal/familial settings as well. It’s a reminder to us all, whether we’re hiding something or not, that anything sent across a wire or tower is being recorded somewhere and can potentially resurface without warning.
